Marta Tonioni joined Zunarelli – Studio Legale Associato in 2015 and became Partner in 2022.

She has experience across various industries, advising industrial operators in the negotiation of commercial agreements and representing clients in litigation, both before courts and in arbitration proceedings.

Thanks also to her academic experiences, she has developed strong expertise in the transport and logistics sector.

She graduated from the LUMSA University (Libera Università Maria Santissima Assunta) in Rome, with a thesis on International Law on “Private Maritime Security Contractors e Vessel Protection Detachments nella lotta alla Pirateria Marittima. Il caso dell’Enrica Lexie”.

In 2023, she was awarded a 12-month research fellowship at the University of Teramo on the theme “Legal effects arising from national transposition of directive 2014/94/EU of the European Parliament and of the Council of 22 October 2014 on the deployment of alternative maritime fuels infrastructure”.

During the academic year 2021/2022 she held the role of Contract Professor for the Comparative Port Regulation Course, part of the Global Development and Entrepreneurship program (Department of Economics) at the Ca’ Foscari University of Venice.

She has been registered with the Bologna Bar Association since 2019.

Notable Cases

  1. Real estate and Logistics – Litigation and Lease Agreements
    Legal assistance in proceedings pursuant to Article 696-bis of the Italian Code of Civil Procedure brought by the landlord against the tenant for alleged damage to the property used for logistics activities, allegedly resulting from a failure to carry out routine maintenance. The dispute was settled, with a simultaneous revision of the lease agreement and the preparation of a maintenance file binding on the parties, aimed at precisely regulating their respective maintenance obligations and preventing future disputes.

  2. Contract Law and Logistics – Litigation concerning Service Contracts
    Legal assistance in court on behalf of the client in a dispute brought by the former contractor concerning multiple contracts for logistics and porterage services. The subject of the proceedings concerned the client's charging of costs for the failure to return pallets, the physical and accounting management of which was entrusted to the contractor, who had recorded numerous shortcomings over the years. The defence concerned the legitimacy of the contractual charging and compensation mechanism and the correct execution of the contract.

  3. Civil Law – Real Estate – Real Estate Litigation
    Legal assistance to a real estate company in a complex dispute concerning the judicial award of an industrial property subject to opposition pursuant to Article 617 of the Italian Code of Civil Procedure by the company against which enforcement proceedings were brought and which was subsequently placed in judicial liquidation. The activity led to the settlement of the dispute with recognition of full ownership of the property to the client, waiver of pending legal proceedings before the Court of Cassation and settlement of the mutual interests between the parties and the financing bank, through the conclusion of a trilateral agreement that definitively ended all claims in relation to the property.

  4. International commercial law – Contracts and protection of know-how
    Preparation of international contracts between Monegasque, Irish and US companies for the production and marketing of a beverage. The activity involved the drafting of a production contract and a know-how licence agreement, aimed at regulating the use of a confidential production process, the supply of semi-finished products and the protection of industrial confidentiality. Particular attention was paid to the protection of industrial secrets, the regulation of information flows between the parties and the definition of the manufacturer's quality and production compliance obligations in accordance with the agreed standards.
