The magazine Bolina has dedicated the latest episode of its podcast to the topic of foreign-flagged boats owned by Italian residents, featuring Alberto Pasino, partner of our Firm.
In the course of the interview, starting from the new Law No. 70 of 7 May 2026 on the “enhancement of the sea resource”, Pasino examines the impact of the new Article 26-ter of the Italian Pleasure Craft Code (Legislative Decree No. 171/2005), which introduces for residents in Italy who own pleasure crafts flying a foreign flag of up to 24 metres the obligation to prove the vessel’s seaworthiness either through certificates issued by the flag State or, where such documents do not exist, by means of a five-yearly survey carried out by a notified technical body.
The podcast explores the main practical and legal challenges raised by this provision, the potential areas of friction with European Union law, and its concrete implications for yachtsmen, charter operators and shipyards, offering a technical-legal perspective aimed at those working in the sector.
