Alberto Pasino contributes to The Hague Convention on Choice of Court Agreements of 2005 – Practical Perspectives

The volume The Hague Convention on Choice of Court Agreements of 2005 – Practical Perspectives, edited by Francisco Ramos Romeu, has been published as part of the UIA–LexisNexis Publication Collection. The book examines the 2005 Hague Convention on Choice of Court Agreements, with particular emphasis on the practical issues arising from its application.

Alberto Pasino, partner at Zunarelli e Associati, contributed the chapter “Exclusion of transport law matters”.

The chapter examines the exclusion of contracts of carriage from the scope of the Convention and the reasons underlying the coordination between the Convention and the specialised international regimes governing carriage by sea, road, rail and air.

Particular attention is given to the qualification of contractual relationships falling within the grey area between contracts of carriage and other contractual arrangements, including freight forwarding and hire contracts, as well as to practical criteria that may assist operators and practitioners when drafting choice of court clauses in transport contracts.
