Dangerous goods: updates on transport checks

 

The Ministry of Infrastructures and Transport, in conjunction with the Ministry of the Interior, published Decree of 13 April 2026 in the Official Gazette No. 125 of 1 June 2026. This measure significantly updates Italian legislation on the transport of dangerous goods by road, transposing the most recent European directives and introducing uniform criteria for checks and operational management.

Specifically, the decree transposes European Directives (EU) 2022/1999 and (EU) 2025/1801, ensuring the technical and scientific alignment of the annexes and introducing uniform control procedures in line with European standards. The legislation aims to standardize the type and methods of inspection of vehicles transporting dangerous goods, providing clear guidance to industry operators and inspection bodies.

The decree applies to all vehicles, including those from the European Union and non-EU countries, travelling through Italian territory, with the exception of military vehicles, which remain exempt from inspections.

The measure came into force on 2 June 2026, but will become fully operational from 24 June 2026, giving operators sufficient time to comply with the new provisions.

The decree also defines the responsibilities of operators and companies involved in the transport of dangerous goods, providing for penalties in the event of non-compliance with the regulations. The checks provided for in the decree will cover both the accuracy and completeness of transport documentation and the technical suitability of the vehicle and safety equipment.

Furthermore, it is important to update internal procedures, transport documentation and staff training in order to ensure safety and compliance with regulatory requirements.

In summary, the MIT Decree of 13 April 2026 represents a major step towards the harmonization of ADR control procedures in Italy, aligning national legislation with European standards and providing concrete operational tools for operators in the sector.
