Opposition to Notice of Violation and Administrative Detention in International Transport: Stay Granted before the Justice of the Peace of Bari

By decree dated 23/09/2026, the Justice of the Peace of Bari granted a stay of execution for the contested penalty order and the related three-month administrative detention imposed on the vehicle combination owned by an Albanian company, represented by attorney Vincenzo Gelao.

The case originates from a check carried out by the Bari Traffic Police on August 31, 2026, during an international transport of goods performed by the applicant company along the Durrës – Detmold (Germany) route.

According to the administrative violation notice, the carrier allegedly carried out the transport in breach of the conditions of use of the CEMT permit, on the grounds that the vehicle had loaded goods in Bari and subsequently unloaded them in Verolavecchia—circumstances that were not recorded in the relevant logbook.

An opposition appeal under Art. 205 of the Italian Highway Code was prepared and filed on behalf of the client company, along with a request for the immediate stay of the detention’s validity, which, as noted, was successfully granted.
