Alberto Pasino will discuss the recognition of foreign judgments and arbitration awards during an international seminar on international private law organized by Union Internationale des Avocats.
The seminar “Recognition and enforcement of foreign judgments and foreign arbitral awards: recent trends and developments”, organized by the Turin Bar Association together with the Union Internationale des Avocats and with the Law Department of the University of Turin will take place in Turin on 30 June 2017.
During the seminar, speakers from Italy and from abroad will discuss the recent developments regarding the recognition and the enforcement of measures abroad. This is indeed one of the most critical aspects of international disputes. If the parties involved are based in different countries, it is essential for the creditor to obtain measures that can be easily and quickly enforced in the legal system where the debtor’s assets are located.
The absence of uniform international rules on enforcement procedures is crucial, as they remain entirely subject to the national laws of the country where the enforcement is requested. Differences between the different national systems result in lengthiness of enforcement procedures, delays in enforcements or even failure to enforce the measures.
The speakers will discuss the issue both from a national and cross-border perspective, with particular reference to current trends concerning the principles set forth in EU Regulations and international conventions.
