Francesca Greblo settled a dispute regarding banking matters through an agreement based on which the Bank had to pay the Firm’s Client Euros 140,000.00.
The company represented by Zunarelli – Studio Legale Associato had sued a leading banking institution before the Court of Pordenone to have the Court ascertain that there were compound interest, usurious interest, overdraft fees and illegitimate expenses applied to the existing ordinary current account contracts and the contracts subject to collection.
In fact, from the analysis carried out on the account holder’s documentation, it had emerged that in several quarters the rates charged by the Bank in the current account contracts were higher than the threshold rates provided by law, and were therefore usurious.
In addition to this, the expert in charge of the analysis had noted the presence of illegitimate compound interest, maximum overdraft charges and usurious expenses that amounted to a total repayment of Euros 198,947.04 due by the bank.
The Court-appointed expert report during the proceedings confirmed the above findings and therefore the banking institution offered to solve the dispute through a settlement agreement, thus avoiding a judgment.
The Court action initiated by the Firm was based on an expert report drafted by Roberto Giansalvo, who permanently collaborates with the Firm.
The results of the Court-appointed expert report fully confirmed the results of Mr. Giansalvo’s expert report, once again corroborating the accuracy of his analyses.
