Banking law
We handle issues concerning irregularities in banking relationships. In particular we advise and represent Clients in disputes against banks and in renegotiating contractual agreements. We provide wide ranging advice on the contents of bank contracts through the analysis of the general terms and conditions of current account, mortgage, financial lease and derivate contracts.
Recent representative matters include:
- we have represented Clients before the Banking and Financial Arbitrator for unlawful reporting in the credit information center;
- we have provided advice in the renegotiation of a series of loan contracts belonging to the bankrupt company with omnibus guarantees given by former partners;
- we have represented several companies and individuals in actions against banks for the breach of the rules on unlawfully applied usurious and compound interest;
- we have assisted several companies in contractual and tortious liability claims against banks due to mistaken notification to Centrale dei Rischi (i.e. the Italian Central Credit Register);
- we have representing Clients in the renegotiation of the contractual terms and conditions applied by their banks.
